It is time to ABOLISH THE CHARTER and go to the Ohio

Revised Code for a  Government that serves the citizens,

not the mobsters and the greedy bankers, developers,

and shyster atttorneys our present charter serves so well.   

 

 

We Americans deserve an honest government.  We have a

God-given right  to a government of people elected by the

people to serve the people.

 

  Under our old (1928) corrupted and patched up City Charter

we are being" provided only with "government of the people." 

 

 

"Government  of the people" is nothing new; Adolph Hitler provided

 

"government of the people" in Germany in the 1930s.  He wasn't having

 

any citizens making any decisions for him; he was the government

 

"of the people."  Fidel Castro is the "government of the people" in Cuba.

 

An organized racketeer group is the actual "government of the

 

people" in Portsmouth.

 

 

Here in Portsmouth unelected greedy racketeer leaders like Banker/Attorney

 

C. Clayton Johnson, and Real-Estate-Predator Neal Hatcher control the

 

membership of the City Council so they will have a minimum of four

 

councilmen to vote like they are told to vote.  Hatcher and Johnson are

 

"the government of the people" in Portsmouth.

 

Control of Council has meant fortunes in tax breaks for a few persons in

 

town while the 'rest of us' pay our taxes and we also pay for the wealthy

 

ones who pay nothing.  Controlling council means many wealthy ones

 

can get by without paying a fair share of city expenses.  For example,

 

two of the town's richest businessmen were given a break on taxes in 2011.

 

 

Property Tax Abatements of Two Million, Six Hundred Thousand Dollars

 

($2.6000.000) were granted.  Jeff Albrecht, a big time operator who ran into

 

diffiulty recently in a land acquisition upriver won't have to pay a dime in taxes

 

for the next twelve (12)  years on the motel across from City Hall he recently

 

rehabbed.  Nothing is added  to the city by this remodel.  There is no mention

 

of additional motel employees that might aid the city with increased income tax. 

 

This appears to simply be another gift to good Ole' Motel Jeff from the city officials. 

 

Why?  We need the tax money.  Will city officials receive free drinks at Jeff's Bar?

 

Or, perhaps they can be rewarded with extra services and a free room for

 

awhile or for a night when they need one?  Someone should get something

 

beside just wealthy Jeff.  The 'rest of us' are not gettting anything except

 

paying more taxes.  Jeff Albrecht is getting a free ride on your shoulders.  You are

 

carrying your tax load and his share also. And of course Neal Hatcher

 

was given a Six-Hundred Thousand Dollar ($600,000) Tax

 

Abatement for the next twelve (12) years on a new building

 

just across Seventh Street from the Post Office.

 

  

Under our present City Charter four council votes is all that is needed to

 

pass resolutions, sell/lease property, pass ordinances to okay secret

 

backroon contracts to purchase overpriced old department stores from

 

their criminal friends (for example Martings Two Million Dollar Grand Theft) 

 

or in the same way, only four council member votes are needed to sell or

 

lease valuable city property to their friends for almost nothing,

 

fire-sale prices. 

 

 

All you need to get criminally wealthy under the

 

City Charter is control of four corrupted councilman.  That's right; four

 

city councilmen voting the way you say is the key to the city vault.

 

 

As Ex-Mayor Jim Kalb often publicy said,"There is a lot of money to be

 

made in real estate."  This is true at Portsmouth City Hall but you must have

 

at least four councilmen on the Devil's payroll to be sure your real estate

 

deals go through so you can properly profit.  Jim Kalb knew what he was

 

talking about.

 

The appointment of new councilmen is necessary when council members get

 

convicted and hauled off to prison; or some councilmen simply move away;

 

or some of them sicken  of being dishonest; and others tire of being told

 

before Council meetings how they are going to vote.  Most amusing of all

 

departing councilmen are the ones who resign or retire quickly from

 

Council after spouse or teen-age children see Daddy out on

 

council night in the wrong place with the wrong person and catch

 

on that the late, late hours Councilman is getting home from meetings

 

is not because of long interviews with the news media.

 

 

Portsmouth City Council has six councilmen, one for each ward.  Four votes

 

are needed to approve the passage of an ordinance or resolution.

 

With less than four votes the proposed action does not  pass;

 

four votes are  needed.

 

IN THE COUNCIL MEETING OF 23 January, 2012 three councilmen voted

 

to deny citizens the right to vote on a question of continuing with 44 police

 

and firemen.  Two of the three councilmen who denied citizens the right

 

to vote on the issue were appointed to the council by the "criminal powers"

 

who have controlled the council for over three decades.  Had either one

 

of the two appointed councilmen voted "for the people" the  citizens

 

would have had a vote on the issue. 

 

 

On the present council are four men who gained their council seat by

 

election.  These two men, James Rich Saddler, Second Ward and John

 

R. Haas got on Council by appointment.

 

On a proposal to allow citizens to vote yes or no on a plan to alter the 44

minimum number of fireman and police in this city three of the elected

councilmen voted YES.  These men were Steve Sturgell, Jim Kalb, and

Kevin Johnson.  These three men were all elected to council.  Three our of

four of these elected men voted to allow citizens to vote on this issue.

 

On the negative side elected Third Ward Councilman Nicholas Basham and

 

both of the appointees, John Haas and Rich Saddler voted against allowing

 

citizens to vote.   And so it is, the appointed councilmen almost always

 

have less council knowledge and usully are inferior to the elected men.

 

   Probably no one expected anything better from Nicholas Basham who has been running a

 

beer joint and is known as a crude man who has bad public manners and talks mean to ladies

 

much like Basham's understudy John R. Haas does. 

 

But "Rich" Saddler was a disappointment to those who believed in him.  And now, citizens will

 

know how such a little value "Rich" Saddler, John Haas, and Nicholas Basham place on an

 

American citizens' right to vote. 

 

“Government by the people and for the people” has perished “from the earth” here at home

 

in Portsmouth, Ohio while we have men and women from our area, in the air, on the seas and

 

on far-off battlefields fighting, giving their time and skill, giving their blood, giving their lives to

 

help the people there to have the right to vote while citizens here at home are denied a vote. 

 

Lord, give us the wisdom, the courage, and the power to shrug off the infernal Charter under

 

which we are suffering and  join Freedom here in America through government under

How big is your water bill?  Did you get an abatement on your property

tax for twelve years?  Were your taxes lowered?   Was your street paved?

Do the sewers still stink?  Did  you see the street sweeper last year?

 

Would you support eliminating the CITY CHARTER and returning to a

government of Democracy with the OHIO REVISED CODE? 

 

Do you favor a RECALL OF THE MAYOR?  Many citizens do, as he continues

to scourge the needy, poverty ridden citizens with massive water bill

increases (Eighteen percent increase on water and sewer)  

while giving special lowered water bill considerations to the criminally rich?

 

David Malone was un-elected Mayor of Portsmouth for the entire year of 2011. 

He received $59,000 plus as Mayor and a $3,000 Bonus at Christmas time. 

When David took office in December 2010; the city was in effect bankrupt,

and it was and is in that condition, because of bad budget legislation David Malone,

Jim Kalb and three appointed councilmen, Mike Mearan, Jerrold Albrecht and

John Rudolph Haas voted into law in February 2009.

 

Mayor David was generous with NEAL HATCHER AND JEFF ALBRECHT,

two of the wealthiest, avaricious, immoral rascals in the area, by furtively

giving them TAX ABATEMENTS FOR TWELVE YEARS.

A total of Two Million, Six-Hundred Thousand Dollars ($2,600,000) to them

in TAX ABATEMENTS.FOR THE NEXT TWELVE YEARS was given by Mayor Malone.  

 A back-room abatement break of Two Million Dollars ($2,000,000) to

 

Jeff Albrecht on his rehabbed motel across the street from City Hall and

 

a Six-Hundred-Thousand-Dollar break to Neal Hatcher on a new building

  

at 915-919 Seventh (7th) Street.

 

Malone also donated One Thousand Dollars ($1,000 ) to the police and fire unions

 

to support their income tax raise.

 

Mayor David Malone also gave big-time water users a massive break on prices. 

 

To balance out this lowered rate for the big-time wealthy users, he was forced

 

to give the “rest of us” an Eighteen Percent increase in our water and sewer bills.

 

We are paying more so the fat-cat Mafia-type controllers of this evil city can pay less.

Mayor Malone is taking care of Neal Hatcher, Jeff Albrecht and C. Clayton Johnson.

LADY HIRED FOR ENGINEERING WHILE

MAYOR TALKS LAY-OFFS

NEW HIRE AT CITY HALL WAS MAYOR JAMES D. KALBS ABLE ASSISTANT

 

Crystal Weghorst was known as a personable, hard working assistant to

 

Mayor Kalb for over three years.  She left the Mayor’s Office when Jim Kalb

 

finished third in a two man race for re-election November, 2009.

 

(Mayor Elect Jane Murray finished first, school administrator Jerry Skiver finished second,

 

and Jim Kalb was in third place and David Malone somewhere below Kalb in votes.)

 

In the Mayor’s Office Ms. Weghorst learned procedures and rules quickly and

never refused or hesitated to deliver copies of public records asked for under

 the Freedom of Information Act. 

 

She was always pleasant and easy to get along with as the Mayor’s Assistant.

 

According to First Ward Councilman Kevin Johnson, she has been wrongfully

 

appointed by City Mayor David Malone to an Engineering position that is beyond

 

her education.

 

This appointment is not surprising to the many who remember Crystal Weghorst’s

 

work in the Mayor’s Office.  She was de facto Mayor much of the time when

 

Mayor Kalb was on lengthy vacations in the Southland where he attended

 

auto race tracks and actually raced on many tracks, including one big run at

 

the Charlotte, North Carolina track.  In Mayor Kalb’s many long absences

 

Crystal Weghorst ran the Mayor’s Office and ran it well.

 Councilman Kevin Johnson has a proper complaint and we are blessed to have

 

an aware, knowledgeable and vocal person such as Kevin Johnson in our city council.

 

Crystal Weghorst is not the main subject to be concerned with here.  The appointee

 

is not the problem; it is the appointer.

  Mayor Malone has been Mayor over one year now and is beginning to believe,

 

as many politicians tend to do, that he is not merely mortal ,but has been chosen

 

and placed in Office by the Almighty Lord as a Divine Ruler.

 

 

To you citizens who attend city meetings, please note: When Mayor Malone speaks

 

please observe that he has arrived at the point where he now actually has come

 

to believe that all the words he speaks are actually the truth.

 

Inside information is Crystal Weghorst did much of the brain-work during the

 

Jim Kalb Administration, including negotiating contracts and in preparing the

 

annual budgets which were to be presented to the Council on or before

 

November the Fifteenth, each year. 

 

Mayor Kalb year after year was late in producing the budget and claimed the Auditor,

 

Trent Williams ,did not have the financial figures available so he, the Mayor,

 

could not prepare the budget by the deadline.  (It was all Trent’s fault. Trent can't count.)

 

 

In last meeting in February, 2009, Mayor Jim Kalb brought a proposed budget

 

to the City Council, and Mayor Kalb explained as he had, for year after year,

 

that he was late because of the Auditor and this was the only chance to

 

pass the budget he was presenting.

 

 

Repeatedly, year after year, Kalb didn’t make the budget available until the

 

last meeting in February; he then claimed it was late and must be treated as

 

an emergency.  Councilmen were not given time to read the budget and

 

citizens never found out what was in it until it had been passed into law.

 

He explained, if the budget were not passed by council as an emergency

 

meeting that night, right now, the city workers would not get paid the

 

following week.  Kalb said there was no time for presenting this budget

 

to the citizens and to the council for their three readings as the law decrees.

 

This was the same old dirty government budget game Kalb planned and played

 

every year.

 

 

This time, with his re-election coming up only nine months away, Mayor Kalb

 

asked that all employees in the city be given a three per cent raise for three years

 

in a row, years 2009, 2010 and 2011.

 

Appointed Councilmen Jerrold Albrecht, Mike Mearan, John Haas and elected

 

Councilman David Malone voted for the big deficit.  Mayor Kalb had written

 

himself in for the three per cent raises for three consecutive year raises and

 

also Mayor Kalb had included the City Solicitor Mike Jones and

 

Auditor Trent Williams.  Solicitor Jones joined in support of the budget and

 

Auditor Trent Williams hesitated saying he did not believe there would be

 

enough money coming in to pay for the raises.  Auditor Trent finally agreed

 

to go along with the bad budget after it was agreed that a new Luxury SUV

 

Auto was to be purchased by the City for the personal use of Auditor Trent Williams.

 

 

There was no time for the councilmen to even read the budget.  But Sixth Ward

 

Councilman Richard Noel and Second Ward Councilman Bob Mollette did read

 

enough to learn that the proposed pay raises of three per cent for every city

 

employee for the years of 2009, 2010 and 2011 would put the city into deep deficit. 

 

These two councilmen refused to sign a deficit budget.

 

(Auditor Trent Williams did take delivery of his luxury auto on the 16th of December 2009

 

near the end of the year when it was clear that the City was more than a

 

Million Dollars behind in being able to pay their bills.

 

THEY HAD A MILLION DOLLAR DEFICIT THAT WAS GOING TO BE INCREASED BY

AT LEAST AN EXTRA MILLION DOLLARS A YEAR, EACH YEAR, FOR TWO MORE YEARS.)

Latest Portsmouth Daily Times (PDT) tyrant arrives in Portsmouth;

he has accepted assignment to stop citizens from bad-mouthing

the evil city and county government officials. This is not new:

The Hatcher/Johnson RICO Ring has making pay-offs to PDT

top local managers, and others for years. This is another attractive

Portsmouth Ohio tradition.

 

The new Daily Times manager is doing what he has been paid to do.

In his editorial he commands us to stop bad mouthing, "it is time

to change the game." 

 

He is right; if you are to control the citizens, their speech must

be limited. This is not new; Adolph Hitler knew this.

 

 

If the editorial in the Portsmouth Daily Times (PDT) on Wednesday, December 28,

 

2011 is a fair example of the failings of new General Manager Michael Messerly, he

 

may not be in town very long.  His writing indicates he makes decisions without knowledge

 

and writes without wisdom.

 

The already bankrupt Heartland Publications can expect a new drop in circulation

 

and income  here in Portsmouth.  And, we can expect very little worthwhile from

 

Messerly's writings except more reasons not to buy the Portsmouth Daily Times.

 

The people of Portsmouth and Scioto County are righteously bad mouthing their

 

governments; they have been and are victims of both the  City and County

 

governments.  Despite many tax increases, water rate raises,  and other financial

 

burdens on the citizens, both the County and the City are nearing bankruptcy.

 

 

The Portsmouth Police Chief and the Scioto County Sheriff both for many years

 

have been wasteful; the County has been under fiscal emergency restraints from

 

the State Auditor for three years and the City of Portsmouth is under a fiscal watch,

 

pending further State investigation.

 

 

Lack of law enforcement is a crime itself in this city and county.  Most officers in both

 

City and County are honest and responsible.  The County Sheriff and the Chief of Police

 

are the opposite.  Lack of honest and proper enforcement for the past eight years has

 

made news across the continent.  The Chief of Police and the County Sheriff have been so

 

ineffective that this area is known as one of the worst drug crime spots in America.

 

That is why federal and state law enforcement moved into this area in force and took

 

charge of the closing of the deadly pain pill-mills.  The area is being cleaned up by the

 

federal and state officers; not because of our Sheriff and Chief of Police.  As Mr. Messerly

 

might say, "it is time to change the game."  It is time to change out our Sheriff and

 

the Portsmouth Chief of Police.

 

The citizens have other good and proper causes to bad-mouth our local officials. 

 

The citizens have been and are being robbed by scoundrel City Council members

in league with big-time thieves who are escaping prison time.

 

In May 2002, five of the six members of Portsmouth City Council voted to purchase a

decrepit old department store building for $1,999,000 from C. Clayton Johnson.

This was a crooked deal all the way in conspiracy with a crooked Mayor and some

corrupt council people.  This was an unadvertised, backroom, secretive action that

ignored the law and ws ruled illegal by the Common Pleas Court.  C. Clayton Johson

operating as the Marting Foundation, one of his shell corporations, still has our Two

Million Dollars.

 

Outraged citizens were determined not to allow themselves to be robbed by the

City Council persons again as they were in the Martings Grand Theft in 2002.

In the summer of 2008 citizens gathered signatures on initiative petitions to

amend the City Charter

 

 In a special election on February 02, 2009 citizens approved an initiative petition

for an amendment to City Charter to force City Council to be more accountable in

spending by making expenditures of amounts of  $100,000 or more for buildings

or building rehab, subject to approval by a vote of the people.

City Council opposed this petition for citizens' participation in large expenditures and for

greater accountability by the City Council.  The citizens won the election.  The vote was close. 

 

The City Hall gang cried, their criminal guidance directors moaned and wailed.

 

Passage of this democratic measure would cause much difficulty for the City officials

 to continue to secretly loot the City Treasury as they had done in the Martings Building

robbery and in many other thefts.

 

The Portsmouth Daily Times, the mouthpiece for the hidden criminal government gang,

came to the rescue with an editorial from JASON LOVINS who advocated that

Democracy be set aside and the election be overturned.

 

A petition against the election , supported by most council members and the city solicitor

was filed in Common Pleas Court and the election was overturned. 

 

As advocated by Portsmouth Daily Times (PDT) Editor JASON LOVINS, Democracy was set aside.

There were happy times in City Hall.  The sun was shining for  the City Hall Gang again

 

and crimes of theft and other felonious acts against the citizens could continue as usual. 

 

 

All was well with City Hall; the officials and their controllers were smiling with their victory

 

for dictatorship.  But, there were gathering clouds of deep darkness developing in the

 

evil conspirators skies; the small remaining element of Democracy led by citzens

 

would not die without a battle.

 

 

The City Hall Gangsters had a battery of big-name, over-priced shyster attorneys working

 

this overthrow of Democracy to help maintain money control of city funds  for the gang

 

and the citizens’ own elected city attorney was working against the citizens.

 

The citizens did not have even one attorney to battle the shysters, and no money to hire one.
 
This was delightful for the Gangster Group and they rejoiced in their victory
over American Democracy that the Portsmouth Daily Times had supported editorially.
 

Without an attorney, the citizens appeared to be helpless and enemies of the citizens

were laughing at them, but their fun would not last .

 

One lone petitioner, Larry Essman, decided "it was time to change the game." 

He prepared an appeal of the local court ruling and filed it with the Ohio Supreme Court.

 

The Supreme Court honored Mr. Essman appeal with a decision in his favor.

 

The Citizen, Mr.Larry Essman, a Certified Public Accountant, won the appeal.

 

The Supreme Court ruled the election stands, the citizens of Portsmouth won;

they won without an attorney. Larry Essman alone, with no law school, and no legal training

beat the likes of high-priced Attorneys George L. Davis III, Stephen Rodeheffer and City

Solicitor Mike Jones.

 

The initiative amendment by the people stands as law and is known as the

 

ESSMAN AMENDMENT.  some people call it the MARTINGS AMENDMENT in memory of

 

the May 2002 Grand Theft of Two Million Dollars ($2,000,000) from our City Treasury by

 

C. Clayton Johnson and his band of organized criminals in the MARTINGS SCANDAL.

 

 

DEMOCRACY IS ALIVE IN PORTSMOUTH.   THANK GOD; THIS IS AMERICA. 

 

LARRY ESSMAN'S FAITH, COURAGE, AND HARD WORK HAS PRESERVED ONE OF OUR

 

MOST PRECIOUS GOD-GIVEN CONSTITUTIONAL RIGHTS.

ordinary mortals when you have a pocketful of new, crisp hundred dollar bills. 

We common people call these Ben Franklin One Hundred Dollar bills “Bens”

PDT General Manager Michael Messerly wants you people to shut up

 In the next to last paragraph of his editorial/propaganda on page A4 of the PDT

on 28 December 2011, Michael Messerly issued commands to us,

 

 

      "Bad mouthing our own community is sport here, and for those of you who do it, get over it,

       because it is time to change the game.”

 

Father Messerly is right, it is time to change the game. Messerly is well named. 

 

He came on board here after Frank Lewis, Wayne Allen, Ryan Scott Ottney and others

have done superb work in returning many readers, who were, in the long, long ago, regular

customers, but had quit reading the Daily Times when they learned that the Times was

controlled by unethical /criminal local interests.

 

These reporters have given great news coverage, have been ambassadors of good will,

have re-gained much of the lost respect and lost circulation despite Editors such as

Jason Lovins who supports dictatorship over Democracy, and  the new Michael Messerly

who comes across as ignorant, hostile, paid-off, and oppressive. 

It is "time to change the game." 

 

Now, citizens, is the "time to change."   Change Michael Messerly out. 

Renew your pledges to never again buy a Portsmouth Daily Times,.........

until Michael Messerly is gone. 

 

Cut the circulation of the Portsmouth Daily Times here and Heartland Publications

will cut Manager Michael Messerly from their payroll here.

 

Heartland Publications would do much better with an honest, knowledgeable,

local newspaper man.

 

Frank Lewis would be a big, big winner for the Times working in management,

if he would take the job.

 in July 2004, "There's a lot of BIG money to be made in real estate."   During Kalb's too
 
lengthy administration, Mayor Kalb did help people who sold real estate to the city at exalted
 
prices make big money;  he also sold our city real estate property in backroom deals at f
 
ire-sale prices and made it profitable for the ones he sold to.
 
 
 
Back-room un-bid, unpublished contracts can be very profitable for the person
 
 
representing the city.  The standard fee is ten percent (10%). There are estimates that
 
former Mayor Kalb came out of the Mayor's Office a very wealthy man. 
 
 
 
At the meeting on Tuesday night expect that our detestable council will give away an alley
 
to unworthy citizens and will likely re-pave it for the recipients and perhaps install lighting,
 
benches, water fountain, heating, air-conditioning, roofing and toilets, all at expense of
 
citizens who likely will never be allowed into the planned gated alley without paying
 
an entrance fee to persons "mobbed up" with the Clayton Johnson/Neal Hatcher
 
Racketeer Inspired Criminal Operations (RICO).
 
    
These same give-away councilmen have nearly totally ignored alleys in the rest of the city. 
 
There are alleys in sections of the city that require a four-wheel drive vehicle to get you through
 
and some of our alleys are mostly dirt and mud holes.  Even in the better sections of the city there

 

are some alleys so trash-filled, infested, and filthy that many of our even bigger rats, cats, and dogs

 

are afraid to go into these alleys after dark.  This is no interest to our councilmen.

 

 

Council doesn't care; most are known rogues who have been placed in office by the

 

special interest gangsters who run this city.  They know their job is to take care of the few

 

powerful people who got them placed in council, and to the Devil with the rest of citizens. 

 

The powerful thieves who run the city are to receive tax breaks, have freedom from prosecution

 

for their crimes and other special considerations such as the gift of a public alley that belongs to all

 

the citizens. 

 

The citizens are expected to pay taxes, keep quiet about official corruption,

 

high water bills and poor service.

Trent Williams's Double Talk

In view of the double talk that City Auditor Trent Williams resorted to in order to evade answering the questions of Frank Gerlach and Jane Murray about city finances at the recent hearing at the Court of Common Pleas, the underlined excerpt from the minutes of  the Portsmouth City Council for 12 January 2004, shown above,*  is revealing. Williams announced in January, 2004, that there were no deficits for the  year just passed, 2003. First Ward councilwoman Anne Sydnor asked how this balancing of the budget had been achieved. Where had the revenues  come from to erase an anticipated deficit?
 
The question could not have been clearer, but Williams replied he “was not sure to what figures she was referring.” Williams gave the same evasive answer more than once when Gerlach asked the same question earlier this month. Williams said he was  not sure what figures Gerlach was asking about. Gerlach, like Sydnor in 2004, was asking for an accounting of the revenues that had help erase the deficit. Williams
said he was not sure which revenues Gerlach was referring to. Williams was being evasive because it
was not  “revenues” that had erased the budget but rather funds that had been transferred from
the Capital Improvement fund.
 
In October, 2003, with the approval of Judge Harcha, the  city had made up the deficit in the General Fund by transferring money from the Capital Improvement fund. By law, the Capital Improvement funds are supposed to be used only for capital improvements, for the city’s infrastructure, and for such structures
as the Municipal Building. But a loophole in the law allows the city to petition  the Common Pleas Court to allow the transfer of CIP funds, which is what was done in 2003 and which is what the city is asking to do again, in 2011. The Capital Improvement funds are the piggy bank that the city periodically empties to pay off city employees.  

 

The sorry condition of the Municipal Building today is a consequence of the funneling of Capital Improvement funds into the General Fund, which is used to pay general operating expenses, such as salaries and benefits for city employees, including fire and police personnel. The  city has been generous to the fire and police personnel in particular because they are a potent political force in Portsmouth, and politicians cannot expect to stay in office if they don’t cater to that powerful political constituency. Now Judge Marshall, presiding in the Common Pleas Court, is being asked again to make an exception, even though, as Gerlach pointed out, the city is not currently in a deficit and has revenues coming in that will assure that it won’t fall into a deficit.

 

Why does the city want the CIP funds to be transferred again? What is the emergency? The

emergency is that the politicians, including City Solicitor Jones (who, last time we checked,

appeared to be  mortgaged to the hilt and beholden to those who control the city financially**)

wants to make sure there is enough money in the city treasury to provide a reported 12% pay

increase in wages for the fire department. Can that be right, 12% for fire personnel in these belt-tightening times? Surely the court is not going to reward the city’s  budget busting-infrastructure wrecking behavior by allowing the transfer again. Will the citizens again have to take it to a higher court to see that justice is done, as it did when it appealed to the Ohio Supreme Court to overturn the Common Pleas

Court’s ruling that City Clerk Jo Ann Aeh had not mutilated recall petitions?

 

The city is now rehiring the same employees, the same people, who negotiated the contracts while

Kalb was mayor that put the city in the financial bind that caused the state to put Portsmouth on a fiscal watch list. Kalb will once again be in a position to help take Portsmouth down the road to

bankruptcy, a road he knows something about, having traveled it himself personally, as did the  unelected, out-to-lunch mayor David Malone and the deadbeat president of city council, John Haas.

 

The court should not allow the city to continue to  follow the same path of misusing capital improvement funds, which  led the state to declare Scioto County the first county ever to be in a fiscal emergency. The city will end up like the county if Williams is allowed to get away with his double talk.

The city and the auditor have made no effort to change the way the city mishandles its finances since the Common Pleas Court approved the transfer in 2003. By approving another transfer, the court will be condoning the way the city auditor cooks the books.

John R. Haas, City Council President; is he confused or just crooked?

Council President Haas took Council and Mayor into another

illegal secret meeting last night, Monday, October 10, 2011,

allegedly to discuss pay negotiations with City Firemen.

Portsmouth is blessed with good city workers and their

pay is enough for them to survive and serve.  Pay could be,

should be, better if our city income were better. 

    

CITY EMPLOYEES NOT OVERPAID -INCOME HAS NOT KEPT UP

  WITH INFLATION FOR YOU, BUT TRENT WILLIAMS HAS BEGGED,

BLOVIATED, AND CONNIVED HIMSELF A 12,000 A YEAR RAISE UP

FROM $40,000 YEAR IN 2007  TO  A PAY OF $52,000 A YEAR

City Auditor Trent Williams has refused to collect proper taxes

and fees from many of the wealthiest citizens in the city,

especially real estate predators Neal Hatcher and Clayton Johnson.

Portsmouth City would have an abundance of money today if Trent

Williams had worked for the citizens and the City instead of

teaming up with such robbers as Clayton Johnson's Mobsters.

For example, in the Martings Two Million Dollars ($2,000,000)

Grand Fraud Auditor Trent Williams not only encouraged the crime 

he also rushed a check for nearly two millions dollars ($2,000,000)

of your tax money to Clay Johnson seven months before Clay

Johnson paid off the mortgages and got clear title to the property.

 

The  question is, "Is Trent Williams afraid of these gangsters or

did he simply cut himself in for part of the profit by getting

"mobbed-up" with Clay Johnson's/SOGP group.  Trent lost us

$2,000,000 on one deal by not following proper procedures  and has

failed to collect tens of thousand dollars, year after year, for

the past eleven years and eleven months.

Time to RECALL Auditor Trent Williams and get a capable

auditor to collect all the monies he is supposed to collect

and everyone can have a pay raise.

Workers in most all departments have some duties that are

hazardous; this includes police and firemen.

FIRE FIGHTERS NOW IN WAGE NEGOTIATIONS.

WILL THEY OFFER TO TAKE A TEMPORARY CUT IN PAY?

Fire Fighters are apparently the highest paid group 

of employees in the city.  Considering the three consecutive

raises of three percent a year for this year and the preceding

two years. That makes a total of nine percent in raises for the

past three years.  Not only fire fighters, all city employees

got these raises.

 

These raises were given to all city and employees were passed in

the budget ordinance of February 2009. 

Three Appointed Councilmen ,Mike Mearan, John Haas, and Jerrold

Albrecht, voted to approve this ordinance. 

Two Elected Councilmen Bob Mollette and Richard Noel

did not vote for the ordinance. They claimed that the Budget of 2009 was

indicating the expenditure of more money than the city would have in

income, and would result in a large deficit.  As you know, they were right;

we ended the year with a shortage of more than a million dollars.

Mayor Jim Kalb, Solicitor Mike Jones and Auditor Melvin Trent Williams,

all in part-time jobs, were in favor of the raises because they were

included in the raises.

These three part-time men were constantly aspiring for higher pay and

Auditor Trent Williams confabulated and connived raises of over

Twelve housand Dollars for himself and Solicitor Jones in the first

three years of this term of office, bringing their pay up from $40,000

to over $52,000,for their part-time jobs.  

Trent also treated himself, with city money, to the purchase of a

luxury SUV which he bought from Glockner’s on December 16, 2009.

This was after Auditor Trent Williams had counted up the loss for the

ear and realized he and the Mayor Jim Kalb had once again made

some serious errors in arithmetic.

The city was more than a million dollars in the hole.   

The place of the rest of the citizens is to keep quiet, pay taxes, and support the powerful few.

and floodwall and transfer these funds to the now overspent, deficit General Fund. 

 

There is no financial emergency.

There is enough money in the City Treasury to pay all bills and payroll for the rest of the year.
