Doctor accused of distributing drugs that led to 14 deaths

COLUMBUS, Ohio (AP) — A doctor and two office managers at Ohio pain

clinics have been accused in a federal indictment of illegally distributing

the powerful painkiller OxyContin and other drugs that led to the deaths

of at least 14 people, federal prosecutors said today.

Dr. Paul Volkman, 60, was arrested Monday in Chicago, where he has a home,

said Fred Alverson, a spokesman with the U.S. Attorney’s Office in Columbus.
Volkman worked out of southern Ohio clinics in Portsmouth and South Point,

where he and two office managers distributed more than 1.5 million pain pills

between 2001 and 2006, prosecutors said.

 

 

A federal grand jury in Cincinnati returned a 22-count indictment against Volkman

and office managers Denise Huffman, 54, and her daughter, Alice Huffman Ball, 32,

both of Portsmouth.

Each faces numerous charges, the most severe being a charge of

distributing a controlled substance that results in death, a felony that

carries a maximum penalty of life in prison, Alverson said.

The indictment named the people alleged to have died but didn’t

say if they lived in Ohio or elsewhere.

James Rion, an attorney for Denise Huffman, denied the allegations.


“They were involved in a legal operation,” he said. “Drugs were

dispensed in a lawful manner.”

It now appears that I made an error in a report posted on this site at 11:30 p.m. on Thursday, August 25, 2005 about the identity of the officer who accompanied Starlene Whitt to her bathroom at her home on August 2, 2005 on Millbrook Avenue and ordered her to leave the bathroom door open while she was in there.

 

Today, Sunday, August 28, 2005, I have just finished talking with a young lady who says she was the 14-year-old girl who stood between the police officer and Starlene Whitt while Ms. Whitt was using her bathroom on Millbrook Avenue on August 2, 2005.  The young witness told me today that the officer who stood in the bathroom door was a Portsmouth Police Sergeant.  She described the officer as being about 6’2”, skinny, short hair. She told me the Portsmouth Police Sergeant told the lady not to close the door while she was in the bathroom.  She said the sergeant stood in the bathroom doorway with his head slightly turned away and eyes at times turned toward Ms. Whitt.  The 14- year-old-witness said she stood between the police officer and Ms. Whitt to give Ms. Whitt some privacy.

 

YOUNG LADY SAID, “CAPTAIN GOINS WAS RESPECTFUL, but the Portsmouth Police Sergeant wasn’t.”

 

Captain Steve Goins of the New Boston Police Department did not enter the home of Starlene Whitt after Ms. Whitt denied his entrance without a warrant, but the Portsmouth Police Sergeant did enter the house to watch Ms. Whitt while she was in the bathroom, according to the 14-year-old girl.  This young lady said that Captain Steve Goins was kind and respectful to the residents during the raid on Millbrook Avenue.  She also said that the Portsmouth Police Sergeant was rude and unkind, and she questioned the Sergeant about a man accompanying a lady to the bathroom.  She said she believed that was a job for a female officer.

 

She said that the police were at the apartments on Millbrook Avenue for over 45 minutes.

 

This young lady said that her mother (Martha Thompson) had always taught them that they should be respectful of the police and look upon police as their friends, but after this raid she is now fearful of police and looks upon most of them with distrust.

- QUESTIONABLE DRUG RAID IN NEW BOSTON -

PORTSMOUTH POLICE REPORTEDLY INVOLVED

According to documents from the Municipal Court Clerk’s Office, the New Boston Police Department and statements from witnesses on the scene, a Drug Raid was performed at an apartment at 4332 Millbrook Avenue, in New Boston late Tuesday afternoon, August 2, 2005.

 

According to witnesses on the scene, nine (9) police officers from New Boston Police Department and from Portsmouth Police Department entered the apartment. 

 

Ms. Martha Thompson, the tenant of the apartment was, at that time, visiting in the next-door apartment of Ms. Starlene Whitt.  Children of the two ladies suddenly came running into Ms. Whitt’s apartment yelling and screaming that there were many police with guns at Ms. Thompson’s home.

 

Martha Thompson said she quickly left Ms. Whitt’s apartment and went outside where she saw police officers with drawn guns inside and outside her apartment.

 

Ms. Thompson identified herself to New Boston Police Captain Steve Goins as the occupant of the apartment that had just been entered.  Ms Thompson said there were nine (9) police officers wearing bulletproof vests and four (4) police cruisers from New Boston and Portsmouth.

 

Ms. Thompson said she was told to sit down inside her apartment on her couch where the police detained her for about fifteen minutes.  Captain Steve Goins questioned her.  She said she told the police that they could search all they wanted to search; she had no drugs in her apartment.  She cautioned the police that she had a large dog in one of the bedrooms; the police told Ms. Thompson they had already met the dog and advised her the dog was too big, and that she should take the big dog downtown and trade it for a smaller dog.  Mrs. Thompson objected to this suggestion.  She said the dog was legal, had tags and rabies shots and she had no intention of trading dogs. The police raiders declined to make further search of her home.

 

After more questioning Captain Goins told Ms. Thompson it appeared that they had taken action on wrong information and he then gave Martha Thompson a copy of the warrant to search her home and advised her, “We’ll be back.”

 

Examination of the door to Thompson’s apartment by Sentinel reporters revealed that the doorframe suffered from a fourteen-inch vertical crack near the lock, and the door would no longer latch properly.  Neither would the dead bolt any longer secure the door from being opened.  Ms. Thompson said she always kept the door locked anytime she went outside because she feared her dog would get loose.  She told reporters the doorframe had previously been slightly cracked but the door would latch properly and the deadbolt would securely hold the door shut.  She claims the door was damaged as a result of the police officers kicking her door open.

 

She told reporters that upon leaving her home the Police went next door to the home of Ms. Starlene Whitt.

 

Both Ms. Whitt and Ms. Thompson told reporters that Captain Goins asked Ms. Whitt for permission to search her apartment.  According to these ladies Ms. Whitt told Captain Goins that if he did not have a warrant he was not going to enter her home.

 

Captain Goins attempted to no avail to persuade her to allow entry into her home without a warrant; the Captain told the lady they could get a search warrant “in a minute;” and Ms. Whitt told him to go get the warrant and they could search.  Ms. Whitt told reporters that after seeing how the police officers had acted at Ms. Thompson’s home she was not going to allow them into her home without a search warrant.

 

The ladies further said police denied Ms. Whitt from re-entering her home and detained her and her children outside for nearly forty minutes.   After many minutes went by Ms. Whitt told the police that it was necessary that she go to her bathroom.  She was eventually allowed to go to her bathroom but a police officer accompanied her and she was told not to close the door.  A 14-year-old girl stood between the police officer and Ms. Whitt while she used the bathroom.

 

Ms. Thompson told reporters that the three children belonging to her and the four children belonging to Ms. Whitt were frightened and highly disturbed during this raid. During most of the time of the detention of Ms. Whitt and her children the fourteen-year-old daughter of Martha Thompson stood at the west corner of the apartment building and held and hugged the trembling, crying two-year-son of Ms. Whitt.

 

In an interview with New Boston Mayor Jim Warren on Wednesday the 24th of August, 2005 Sentinel reporters were told that the Mayor had received no report of the raid from the Police Department and had received no formal complaint from the persons on Millbrook Avenue.

 

At about 1:00 p.m. on August 24, 2005 Police Chief Darrold Clark told reporters he was aware of the raid on Millbrook Avenue, but to his knowledge none of the officers had entered the apartments on August 2, 2005.  Chief Clark said,  “Just because you got a search warrant don’t mean you are going ahead and serve it.  Anytime along the line if something comes up, if information comes up, that says no, you’re wrong, you better back off, that’s not the right thing to do, then you better back off and that’s what they did.”

 

The Sentinel has received information that the Portsmouth Police Department was seen on Millbrook Avenue in New Boston on Wednesday, August 24, 2005, apparently investigating this incident.

 

We hope to be able to interview New Boston Police Captain Steve Goins, and other officers tomorrow.  The Sentinel staff plans more information will then be available for publication.
